Pennsylvania personal injury law puts the burden on the injury victim

If you have been injured by the negligence of another, you may be entitled to recover compensation for your present and future medical expenses, lost income and diminished earning capacity, pain and suffering, emotional distress and other legally recognized personal injury damages. However, the law places the burden on you to recover that compensation from the negligent party. This means you must be able to prove that the other party was negligent (that they breached a duty of care they owed to you), and that their negligence caused your injuries. You must also be able to prove the nature and extent of your injuries, including how those injuries may impact your life in the future.

Simply proving a personal injury case is difficult enough, but this task is made even harder by the fact that the other party will be represented by insurance company lawyers who defend against personal injury claims every day and will challenge you at every step. They will claim that the accident did not happen the way you said it did and that your injuries are exaggerated, nonexistent, or existed before the accident. They may also try to prove that your own negligence caused the accident or contributed to it. Any percentage of fault they can lay on you reduces your recovery, and if they can convince a jury you are more than 50% to blame, then you can be shut out of any recovery whatsoever. This is why it is so important to have an attorney on your side who is knowledgeable, experienced and aggressive.

Automobile Accidents

Automobile Accidents

Car accident injury victims often have a difficult time recovering for the full amount of their loss due to Pennsylvania’s complicated scheme of insurance. If you chose only limited tort coverage, Benedum Law can help determine if you suffered a “serious injury” under the terms of your policy that will allow you to pursue full compensation for your harm.

Premises Liability

Premises Liability

Property owners need to keep their premises safe and free of danger for persons lawfully on their property, but the extent of their duty depends on the reason the injured victim was on the premises in the first place. Whether the property owner violated a duty to warn you of known dangers or to inspect and maintain their property free of hazards, Benedum Law can help you recover compensation after a slip and fall, trip and fall, or other accident caused by an unsafe condition on another’s property. From dog bites to assaults caused by negligent security, Benedum Law knows how to prepare and present a persuasive case establishing the property owner’s liability, in cases of icy sidewalks, spilled liquids and other hazards.

Construction Accidents

Construction Accidents

Working in the construction industry is one of the most dangerous jobs one can have. After an on-the-job injury, construction workers may be entitled to workers’ compensation benefits, but payments under the Pennsylvania workers’ comp system may not be enough. For instance, workers’ compensation only makes up for a portion of lost wages and only for a limited period of time, and workers’ compensation does not pay anything to compensate for a worker’s pain and suffering. In appropriate cases, Benedum Law can help injured construction workers obtain additional compensation through civil actions against property owners, general contractors, subcontractors and other third parties whose negligence caused or contributed to the accident.
